1. PREREQUISITES:
a. Must be an enrolled RBC sculler or RBC staff member for the current calendar year and must have completed all forms (RBC Enrollment and US Rowing Membership + Waiver).
b. Must register for a minimum of one session during the OTW season. Renting can be concurrent with session with coach approval (below).
c. Must be 18+ and use only pre-approved boats (i.e., observing weight limits).
d. Must be pre-approved by RBC coaching staff based on skill level and assessed ability to safely self-rescue without a coach/launch present. Use of Personal Flotation Device (PFD), safety whistle, or cell phone in waterproof bag may be required and are at the coach’s discretion based on ability and sculling experience.

NOTE:
RBC strongly recommends a “buddy system” for anyone renting singles.

2. SCHEDULE & PAYMENT:
The RBC Equipment Rental Coordinator (“ERC”) shall be responsible for scheduling usage and collecting fees. Desired usage days and times shall be requested via e-mail to rentals@rochesterboatclub.org, even if a coach is present in the boat or safety launch, to ensure there are no conflicts.
Fees shall be paid in advance, or on the day of boat rental, by leaving cash or check in an envelope dropped into the payment box inside the boathouse. Please indicate on envelope name, date, what payment is for and amount. Prices for rental are as follows:
• $20 for up to two hours (including oars).
• $30 for a double for up to two hours (including oars).
• If applicable, coaching fees will be agreed upon and paid separately.
Boats shall be rented only during daylight hours and shall be in 2-hour increments start to finish and must not interfere with launching and docking of boats during scheduled RBC classes.

3. BOATHOUSE PROCEDURES:
Equipment Chair shall go over usage and boathouse procedures in person. Rower shall comply with all RBC procedures for opening and closing the boathouse and will secure the facility prior to each row and when departing the boathouse at the end of the row. Rower shall also:
a. Record date, time, & direction of row (East/West) in the Logbook located near people door.
b. Follow the direction of traffic while on the canal and observe all standard safety rowing practices in accordance with US Rowing recommendations, particularly regarding inclement weather or water hazards.
c. Leave boathouse and equipment in the condition it was found; boat shall be wiped down using Boat Wash and towels available.
RBC reserves the right to terminate the Agreement should Renter be in violation of this provision.

4. INDEMNITY:
Renter, for himself or herself, including agents, heirs, executors, administrators, and assigns does hereby indemnify and agree to hold RBC, its agents, and assigns, FREE AND HARMLESS from any and all claims, demands, actions, causes of action, damages, attorney’s fees, and costs of every kind and nature whatsoever as the result of, or arising out of, injury incurred during Renter’s use of equipment while on the premises, which includes the boathouse, surrounding area, RBC bathroom, parking lot and dock, as while as during the on-the-water time. In addition, Renter shall, upon demand of RBC agents or assigns, provide at Renter’s own cost all necessary defense of RBC from any such claims, or demands, actions, or cause of actions.

5. INDEMNITY:
Renter assumes all RESPONSIBILITY for any loss or damage to property leased under the terms of this Agreement.

6. ENTIRE AGREEMENT, GOVERNING LAW, FORUM SELECTION:
This Lease is the entire agreement between Renter and RBC and may not be changed or ended orally. This Lease shall be governed by New York State law, and any suit arising from the same must be brought in Monroe County Supreme Court. In the event RBC is required to obtain the services of an attorney to enforce any of the provisions of this Lease, Renter agrees to pay, in addition to the sums due hereunder, an additional amount as and for reasonable attorney’s fees and costs incurred.

7. SEVERABILITY:
If any portion of this Agreement is found to be invalid, it does not negate the remainder of the same.

8. BINDING AGREEMENT:
This Lease is binding upon, and shall inure to the benefit of, RBC and Renter and their respective heirs, legal representatives, successors, and assigns.
Renter acknowledges that he/she has read, understands, and agrees to be bound by the terms and conditions of this agreement.
